Regulation (EC) No 861/2007 of the European Parliament and of the Council establishing a European Small Claims Procedure
European Regulation No 861/2007 ("European Small Claims Procedure") creates a Europe-wide, uniform and simple procedure for the judicial enforcement of small and uncontested claims. The European small claims procedure can be optionally selected instead of the procedures provided by national civil procedure law. The Regulation No 861/2007 was fundamentally amended by European Regulation No 2015/2421 of 16 December 2015. In particular, the maximum value of claim for the European Small Claims Procedure has been raised to Euro 5,000. The rules of the Small Claims Procedure applied from 1 January 2009 whereas the new amended rules of the Regulation No 2015/2421 apply from 14 July 2017. The Regulation applies to all Member States apart from Denmark.
